A federal judge has sided with the Second Amendment Foundation on key points of an on-going legal action against the City of Chicago that challenges the city’s municipal code regarding gun ranges inside the city.
The case, Ezell v. City of Chicago, challenged the city’s code by asserting that the regulations involving installation and operation of gun ranges inside city limits are burdensome. In a 32-page decision, U.S. District Court Judge Virginia M. Kendall concurred with SAF’s positions on the city’s zoning and requirements regarding hours of operation. SAF had earlier defeated the city’s total ban on gun ranges in 2011.
“While SAF did not get complete relief with Monday’s ruling,” said SAF founder and Executive Vice President Alan M. Gottlieb, “our persistence in this issue, coupled with effective litigation, caused the city to actually repeal many of the rules we challenged, even before the court could address them. That’s an indication the city knows there were problems with the code as written, and it demonstrates that when an in-depth analysis of gun laws is undertaken that requires proponents to prove those laws would be effective, they can’t.”
“Every day on which Chicago loses some of its unconstitutional laws,” observed attorney Alan Gura, who represents SAF in this litigation, “is a better day than the one before. This latest decision brings Chicago that much closer to the rest of America, where responsible, law-abiding people can practically access gun ranges for safety training and recreation. We are studying our options for improving this positive outcome.”
In her ruling, Judge Kendall noted that Chicago police officials “admitted that they had no data or empirical evidence that any criminal impact would occur due to the presence of a firing range, or that it would be lessened by placing ranges in manufacturing districts.” Indeed, plaintiff’s expert Lorin Kramer “testified that he was unaware of any location throughout the country where crime increased as a result of a gun range in that location.”
SAF is also represented by attorney David Sigale. Additional plaintiffs are Rhonda Ezell, for whom the case is named, plus Joseph Brown, William Hespen, Action Target, Inc., and the Illinois State Rifle Association.

According to the Shreveport Times, Landrieu’s campaign is trying to put distance between the Senator and her gun control vote by pointing to other votes she “cast favoring gun ownership.”

Senators Chris Murphy (D-CT), Richard Blumenthal (D-CT), and Dianne Feinstein (D-CA) have added their voices to Moms Demand Action for Gun Sense in America’s campaign for Kroger to ban the open carry of firearms in its stores.
On August 18 Breitbart News reported that Moms Demand launched a campaign aimed at pressuring Kroger into changing its gun policy. Current Kroger policy abides by local and state regulations.
Moms Demand wants Kroger to ban the open carry of guns, even where it is legal.
According to The Hill, Senators Murphy, Blumenthal, and Feinstein sent a letter to Kroger CEO W. Rodney McMullen on September 30 asking him to ban open carry in all Kroger stores. The Senators argued that “gun extremists… have exploited the current Kroger gun policy” by carrying guns openly while shopping.
They said that by banning open carry, “Kroger would be sending an important message about [their] commitment to the safety of [their] employees and customers.”

The Rhode Island Health Department says a child has died from complications of an unusual respiratory virus that has been affecting children across the U.S.
Health officials said Wednesday that the 10-year-old girl died last week of a staph infection associated with the enterovirus 68 infection, which it called “a very rare combination.”
“We are all heartbroken to hear about the death of one of Rhode Island’s children,” Dr. Michael Fine, director of the Rhode Island Department of Health, said in a statement. “Many of us will have EV-D68. Most of us will have very mild symptoms and all but very few will recover quickly and completely. The vast majority of children exposed to EV-D68 recover completely.”

The Firearm Safety Act of 2013 is hitting its one-year mark in Maryland, and a local gun shop owner says sales have increased significantly since the law went into effect.
Parker Bandy, owner of Antietam Firearms, said he knew it would take about a year for people to come around.
“Now they accepted it, we’re helping them get their HQL (handgun qualification license),” Bandy said. “We’re helping them get what they seek, because what they’re after is personal protection. That what we’re all about here.”
Before getting a handgun license in Maryland, you now have to go through training, get fingerprinted and go through a background check with State Police.
Marcia Wise, a local gun owner, said she feels it’s important for people to know how to properly use a handgun, even if they don’t want to own one.
“If you’re in a situation in someone’s home and, say, they are not properly securing their weapon and a kid gets a hold of it,” Wise said. “So you know how to get that and take care of that, and disarm that weapon, that way no one can get hurt.”

People who fear a close relative may commit gun violence will be able to petition a judge to temporarily remove the person’s firearms in California, under a bill signed into law on Tuesday by Democratic Governor Jerry Brown.
The legislation – the first such measure in the United States – was introduced after police in Isla Vista near Santa Barbara said they were unable to confiscate weapons from a man who later went on a rampage and killed six people, despite concern from his family.
“In the case of the Isla Vista shooter, Elliot Rodger, his mother was noticing that he was becoming more agitated and making these threats of violence, but there was little she could do and little the police could do,” said Democratic Assembly member Nancy Skinner of Berkeley, who introduced the bill along with Santa Barbara Democrat Das Williams.
Under the so-called gun violence restraining order in the court system, immediate family members and law enforcement agencies could ask a judge to order guns temporarily removed from certain individuals.
The restraining order would last 21 days, and could be extended up to a year, after a notice and a hearing.

- It is necessary.
- It is good.
- It makes outcomes better than they otherwise would be.
Point number one, the necessity of government, is true up to a point. There is arguably some limited set of functions that might better be performed jointly rather than separately. Extreme libertarians believe otherwise, suggesting there is virtually no role for government. Our Founders disagreed and provided for a quite limited role in the founding documents.
The second two conditions, at least given what our government does today, are increasingly disputed by those who look at government objectively. If these latter two become widely accepted as untrue, then the role of government will be reduced dramatically. Government will do anything it can to prevent its reduction. It is this risk which leads to government desperation. It will do whatever it can to protect its privilege and plunder.
Government Integrity: An Oxymoron
What does government do when it is failing? Why it lies, of course, just like a criminal enterprise. It lies about anything it believes it needs to and can get away with. When you have the media running interference for you and an opposition party too cowardly to blow the whistle, that means you can lie just about anything and get away with it.
Even under normal conditions government fudges numbers to support its actions and policies. Government always benefits from making conditions look better than they are. A true understanding of what government does, as opposed to what it pretends to do, would mean its end, at least in any form resembling its current size, configuration and responsibilities.

Should malls and stores ban the carrying of firearms? Connecticut’s two U.S. Senators are calling on the nation’s retailers to voluntarily ban guns in the name of public safety.
A new FBI report indicates that there is an ‘active shooter’ incident in this country now about once in every three weeks and nearly half of those incidents occur in malls, stores and other businesses.
The ‘Target’ department store chain made headlines this summer when they asked their gun owning customers to leave guns at home while shopping saying firearms create an environment at odds with family friendly shopping.
“The reality is that we have data showing a disturbingly high level of mass shootings in retail establishments,” said U.S. Senator Chris Murphy (D) Conn.
Connecticut’s two U.S. Senators Tuesday called on other retailers to join ‘Target’ in making the same request. Pointing to an FBI report showing active shooter incidents on the increase in areas of commerce.
“It documents and demonstrates not only an epidemic of gun violence but the increasing incidence of mass shooting in this country,” said Sen. Dick Blumenthal (D) Conn.
“What we are trying to do is puncture a hole in the gun industry’s argument that everyone in this country needs to be armed at all times in order to protect themselves,” added Murphy.
